This website is operated by Fresh&Faded LTD. Throughout the site, the terms “we”, “us” and “our” refer to Fresh&Faded LTD. Fresh&Faded LTD offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms, you represent that you are at least the age of majority in your country/region of residence, or that you are the age of majority and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only.
This site may contain certain historical information. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information.
SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part) without notice.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance.
SECTION 5 - PRODUCTS OR SERVICES
Certain products or services may be available exclusively online through the website.
We reserve the right to limit the sales of our Services to any person, geographic region or jurisdiction.
We do not warrant that the quality of any services will meet your expectations, or that any errors will be corrected.
SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may limit or cancel quantities purchased per person, per household or per order.
You agree to provide current, complete and accurate purchase and account information for all purchases and to promptly update your account details.
SECTION 7 - BOOKINGS, APPOINTMENTS & PURCHASE OF SERVICES
A booking is deemed to be submitted when you enter valid payment details into our website and confirm the booking by pressing the relevant button. No booking is accepted until our website displays a confirmation message and you receive an email confirmation.
Your submission of a booking amounts to an offer to enter a contract to buy the services from us; you cannot withdraw or cancel except as stated in these Terms.
We reserve the right to decline or cancel any booking at our discretion.
SECTION 8 - DEPOSITS, CANCELLATIONS, NO-SHOWS & CHARGEBACKS
8.1 Deposits
All appointments require payment of a deposit at the time of booking (unless stated otherwise). The deposit secures the appointment slot and is applied toward the total service price.
Deposits are non-refundable except where required by law.
8.2 Cancellation Policy (48-hour
notice)
Customers must provide a minimum of 48 hours’ notice to cancel or reschedule an appointment.
Cancellations/rescheduling must be completed via our online booking system (or by contacting us directly if the booking system is unavailable).
8.3 Cancellation within 48 hours (automatic forfeiture)
If the customer cancels, attempts to cancel, reschedules, or contacts us to cancel within 48 hours of the scheduled appointment time, the deposit will be automatically forfeited and is non-refundable.
This applies regardless of the reason for cancellation.
8.4 No-shows
If the customer fails to attend the appointment (“no-show”) or does not make contact, the deposit will be automatically forfeited and is non-refundable.
8.5 Late arrivals
If a customer arrives late, we may not be able to provide the full service within the remaining time. If the appointment cannot reasonably be completed due to lateness, it may be treated as a missed appointment and the deposit will be forfeited.
8.6 Right to charge full service amount (late cancellation / missed appointment fee)
Where the customer cancels within 48 hours, fails to attend, or is unable to receive the service due to late arrival, the customer agrees that Fresh&Faded LTD reserves the right to charge the full service price (or the remaining balance after the deposit) as a late cancellation fee / missed appointment fee.
By booking and paying the deposit, the customer expressly authorises Fresh&Faded LTD to take payment of the remaining balance using the payment method provided at the time of booking.
8.7 Coverage area / location eligibility (customer responsibility)
Fresh&Faded LTD provides mobile services only within our stated coverage area as displayed on our website and/or during the booking process.
It is the customer’s responsibility to:
confirm their address is within our coverage area before booking; and
provide a complete and accurate service address.
If the customer books and:
the address is outside our coverage area; and/or
the address provided is incorrect/incomplete; and/or
access/location restrictions prevent us from attending,
the booking will be treated as a customer cancellation, and the deposit will be automatically forfeited and non-refundable.
Where applicable, we also reserve the right to charge a call-out fee or the remaining balance if we have already travelled, allocated staff, or incurred costs.
8.8 Chargebacks / payment disputes
By making a booking and paying a deposit, the customer acknowledges and agrees that:
the deposit reserves a specific time slot;
the deposit is a genuine and fair contribution toward our losses;
the customer has read and accepted these Terms at the time of booking.
Customers agree they will not initiate a chargeback, card dispute or payment reversal in relation to any deposit or charge validly applied under these Terms.
If a customer raises a chargeback, we reserve the right to provide booking records, communications, IP/device logs, location details, attendance records, and acceptance of Terms to the payment processor/card scheme.
Where a chargeback is raised without lawful basis, we reserve the right to recover losses including chargeback fees, administrative costs, and any outstanding appointment fees.
SECTION 9 - MOBILE SERVICE CONDITIONS (ACCESS, PARKING, SAFETY)
For mobile appointments, the customer agrees to provide:
safe and lawful access to the service location;
suitable space for the service;
reasonable parking/loading access.
If we are unable to safely or legally provide the service due to access issues, unsafe conditions, threats/abuse, aggressive behaviour, intoxication, or environmental hazards, we reserve the right to end the appointment immediately. This will be treated as a customer cancellation/no-show and charges may still apply.
SECTION 10 - SERVICE LIMITATIONS (NO WOMEN’S HAIR)
Fresh&Faded LTD provides barbering/grooming services as advertised.
We do not offer women’s hair services and do not cut women’s hair.
We reserve the right to refuse any booking that falls outside our service offering.
SECTION 11 - OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available” without warranties.
SECTION 12 - THIRD-PARTY LINKS
We are not responsible for third-party websites, materials or services.
SECTION 13 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
You agree we may use and publish any comments you submit without restriction.
SECTION 14 - PERSONAL INFORMATION
Your submission of personal information is governed by our Privacy Policy.
SECTION 15 - ERRORS, INACCURACIES AND OMISSIONS
We reserve the right to correct errors and cancel orders if information is inaccurate.
SECTION 16 - PROHIBITED USES
You are prohibited from using the site for unlawful acts, harassment, malware, scraping, etc. We may terminate access for violations.
SECTION 17 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
The service is provided “as is” and “as available” without warranties to the fullest extent permitted by law.
In no case shall Fresh&Faded LTD be liable for indirect or consequential losses including lost profits, lost revenue, or loss of data.
SECTION 18 - INDEMNIFICATION
You agree to indemnify and hold harmless Fresh&Faded LTD from claims arising from your breach of these Terms.
SECTION 19 - SEVERABILITY
If any provision is unlawful or unenforceable, the remaining provisions remain in effect.
SECTION 20 - TERMINATION
We may terminate or restrict access at any time without notice if you breach these Terms.
SECTION 21 - ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and us.
SECTION 22 - GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
SECTION 23 - CHANGES TO TERMS
We may update these Terms at any time by posting changes to our website.
